Mediation
Is Mediation For You?
Mediation is a co-operative, problem solving process in which individuals work with a trained, impartial mediator to reach mutually satisfactory solutions to their disputes. Divorce mediation serves both parties by offering a place where issues of fairness, equity, and security are honored in the negotiated decisions. I provide mediation services for divorcing or separating couples, as well as issues for post-divorce and unmarried parties.
Divorce/separation issues decided in mediation:
- Determination of spousal support
- Division of Assets and Debts
- Creation of a Parenting Plan
- Calculation of child support
- Post divorce modifications
Advantages of mediation for divorce:
- Opportunity to reach a fair financial settlement agreement
- Restore self determination and dignity
- Cost and time effective, providing timely closure on contended issues
- Relieve anxiety, clarify parenting roles
- Establish two positive family households
- Provides a written Mediated Settlement Agreement document
Consider this:
Most couples that come to us regarding divorce or separation are in different emotional places. Often one party does not want the divorce and may not yet able to accept that it is happening, while the one who initiates the divorce feels the pain and responsibility for upsetting the family. At Stillpoint Services, we offer three levels of support to help couples work this through.
- Mediation: Gloria Bryen provides valuable practical support for both parties, guiding parties through the decision-making process, the closure of circumstances, the separation of assets, the determination of financial support, and especially the plans for caring for the children. The decision-making process invites personal healing, even as parties separate, let go, and look to the future.
- Coaching: Sometimes one spouse is unwilling to participate in mediation. In such cases, Gloria works with individual spouses to provide coaching and information regarding the divorce process. Parties needing legal advice will be encouraged to visit an attorney.
- Counseling: When needed, therapist David Bryen is available to assist in the emotional transition, working one on one with either party to help work through grief and anger, fear of the future, feelings of rejection, or desire for revenge. He also can meet with divorcing parents to help them "uncouple", to avoid remaining as "divorced" to each other as they were married, causing themselves more pain and the risk of passing emotional damage on to their children.
Wherever you are today in this process of divorcing, actively joining a discussion with your spouse will help you get clarity for yourself and advocate for what is important for you and your children. Mediation or counseling can provide the venue for this discussion.
A mediated divorce:
- Less costly, less time consuming
- Confidential, private
- Decided outside of court
- You make the decisions
- Voluntary
- Provides closure
- Helpful to children
- Fair and equitable results
- Sets the stage for a workable, ongoing parenting relationship
A contested divorce:
- Expensive, lengthy
- Public court process
- Decisions made by a judge
- Involuntary
- More destructive to children
- Produces a winner and a loser
- Sets the stage for ongoing resistance and non-cooperation
